There’s a precedent new action happening on the job market. Employers are now refusing to hire people that smoke cigarettes, even if they only smoke at home. They say that smoking is a poor choice and they don’t want to hire people that make poor choices for themselves. That way, they’re not in direct violation of civil liberties laws that protect us from people who would take away the rights of others.
People all over are wondering if it’s even legal to demand that employees do something when not at work and not get paid for it. That seems a little like a dictatorship, not a free country! How people behave while not on the clock should be kept separate from their work codes. And, while some don’t like it, tobacco is a legal substance, and the workplace shouldn’t be able to say their employees can’t do legal activities.
Some employers have stated that they would rather reward people who have acceptable habits and lifestyles than employ someone while supporting their bad choices.
Have Employers Taken the No Smoking Rule too Far ?
Cigarettes are expensive and medical costs incurred by smokers are higher in comparison to the nonsmoker. The federal government figures that smokers cost employers nearly $3400 a year (on average) in higher health care costs and loss of production. However, the figures don’t add up when considering faithful employees who smoke but never call in sick and there are nonsmokers with serious health problems. It’s not like only smokers get sick.
So far, the courts have upheld the practice of disregarding someone because they use tobacco, but some day, someone will bring a class action law suit against a company, citing their right to do something legal in their own time.
During this recession employers can be nit-picky and hold out for someone who’s qualified better as hundreds apply for single openings. It won’t be hard to uphold the new rule, as people will do what they have too to get a job, even if it makes someone unhappy about it. It might make people give up the smoking habit; maybe, but most likely they’ll just whine about it and keep smoking.
